Terms & Conditions – The Chimney Guy

1. Introduction
These Terms & Conditions (“Terms”) govern all repair, maintenance, inspection, and related services provided by The Chimney Guy (“we,” “us,” or “our”). By scheduling service, approving an estimate, or allowing work to begin, you (“the client,” “you,” or “your”) agree to these Terms.
2. Estimates & Pricing
- All estimates are based on visible conditions at the time of inspection.
- Additional issues discovered during service may require updated pricing or additional authorization.
- Estimates are valid for 30 days unless otherwise stated.
- Prices do not include permits, specialty parts, finish work, custom or non-compliant materials. Some examples: Non heat rated caulking, general purpose construction adhesive not fire rated, non refractory patching compounds, Improper flue materials or not UL listed, brick veneers, siding, or any type of low fire brick.
3. Scheduling & Access
- Clients must provide safe and reasonable access to the work area.
- Missed appointments or inaccessible job sites may result in a trip fee.
- Appointment windows are approximate; delays may occur due to traffic, emergencies, or prior jobs.
4. Service Authorization
By approving an estimate or allowing work to begin, you authorize:
- Our technicians to enter the property and perform the agreed‑upon services
- Reasonable adjustments or minor modifications needed to complete the work safely
- The use of photos or videos for documentation, insurance, or warranty purposes
Any realtor, assistant, property manager, or individual acting on behalf of the homeowner who provides approval for service confirms that our technicians are permitted to access the property and carry out the authorized repair work.
We will always seek approval before performing additional chargeable work.
5. Payment Terms
- Payment is due upon completion of service unless otherwise agreed in writing.
- We accept Checks, Zelle, Cash, CC, ACH.
- Late payments may incur fees or interest as permitted by law.
- Returned checks or failed payments may result in additional charges.
6. Warranties & Limitations
- Workmanship warranties apply only to the specific service performed and only for the stated warranty period.
- Warranties do not cover:
- Pre‑existing issues
- Faulty work performed by another repair company
- Damage caused by misuse, neglect, or unrelated system failures
- Natural wear and tear
- Weather‑related or environmental damage
We are not responsible for coordinating with, supervising, or working alongside other trades or contractors on the property. We are not liable for any delays, damage, interference, or issues caused by their work, actions, or presence during the project.
Manufacturer warranties apply only to eligible products and are subject to their terms.
7. Client Responsibilities
Clients agree to:
- Provide accurate information about the issue
- Ensure the work area is safe, accessible, and free of hazards
- Follow any post‑service instructions provided by the technician
- Notify us promptly if issues arise after service
Failure to follow instructions may void warranties.
8. Liability
To the fullest extent permitted by law:
- We are not liable for indirect, incidental, or consequential damages.
- Our total liability is limited to the amount paid for the specific service performed.
- We are not responsible for hidden conditions, structural defects, or code violations not visible during inspection.
9. Cancellations & Rescheduling
- Appointments may be rescheduled or canceled with 24 hours’ notice.
- Same‑day cancellations may incur a fee.
- Emergency or after‑hours cancellations may be subject to additional charges.
10. Use of Photos & Documentation
We may take photos or videos for:
- Service documentation
- Warranty records
- Insurance or compliance purposes
- Limited promotional use, only when appropriate and without identifying client information
We do not use client property images for marketing without written consent.
11. Third‑Party Services
If subcontractors or third‑party specialists are required:
- We will inform you before work begins
- They are responsible for their own workmanship and warranties
- We are not liable for delays or issues caused by third‑party providers
12. Governing Law
These Terms are governed by the laws of the State of California Any disputes will be handled in the appropriate courts within that state.
13. Changes to These Terms
We may update these Terms periodically. The most current version will always be available upon request or posted on our website.
